These Terms and Conditions ("Terms") govern your access to and use of our Site, and any purchase of products from us. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

We may update these Terms from time to time. The current version will always be available on our Site. Continued use of the Site after changes constitutes acceptance of the updated Terms.

Element3 sells dietary supplements. Our products are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. They are designed to supplement a balanced diet and healthy lifestyle.

If you have a medical condition, are pregnant or breastfeeding, or are taking medication, consult your healthcare professional before using our products.

We make every effort to ensure product descriptions, images, and nutritional information on our Site are accurate. However, we do not warrant that product descriptions or other content on the Site are error-free, complete, or current.

You must be at least 18 years of age to make a purchase from our Site. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate and complete.

Placing an Order When you place an order through our Site, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, including product availability, pricing errors, or suspected fraud. You will receive an order confirmation email. This confirmation does not constitute acceptance of your order — acceptance occurs when we dispatch your order.

Pricing All prices on our Site are displayed in New Zealand Dollars (NZD) and include GST (where applicable). We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time you place your order. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order for a full refund.

Payment We accept payment via the methods displayed at checkout (e.g., credit card, debit card, Apple Pay, Google Pay, Afterpay/Laybuy). All payments are processed securely through our third-party payment gateway. We do not store your full payment card details.

We offer a "Subscribe & Save" option for selected products. By subscribing, you agree to the following:

Your subscription will automatically renew at the frequency you select (e.g., every 30, 60, or 90 days) until you cancel. Your payment method will be charged automatically at each renewal.

You may pause, skip, modify, or cancel your subscription at any time through your account dashboard or by contacting us at hello@element3.co.nz . Cancellation takes effect from the next billing cycle. You will still receive any orders already processed.

Subscription pricing may change. We will give you at least 14 days’ notice of any price increase, and you may cancel before it takes effect.

We currently ship within New Zealand. International shipping (including Australia) may be available — check the Site for current delivery options.

Estimated delivery times are provided at checkout and in your shipping confirmation email. These are estimates only and we do not guarantee delivery dates. Risk of loss or damage passes to you upon delivery to the address you provided.

If your order is lost or damaged in transit, please contact us at hello@element3.co.nz within 7 days of the expected delivery date and we will investigate and resolve the issue.

Under the New Zealand Consumer Guarantees Act 1993 ("CGA"), our products come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to limit or exclude your rights under the CGA or the Fair Trading Act 1986.

If your product arrives damaged, defective, or incorrect, we will replace it or issue a full refund at no cost to you.

Change-of-mind returns are accepted within 30 days of delivery, provided products are unopened and in original condition.

For health and safety reasons, we cannot accept returns of opened supplement products unless they are faulty.

All content on our Site — including text, images, graphics, logos, product names, and trademarks — is the property of Element3 Limited or its licensors and is protected by New Zealand and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our Site without our prior written consent.

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

The information provided on our Site (including product descriptions, blog content, and quiz recommendations) is for general informational purposes only and does not constitute medical advice.

Our products are dietary supplements regulated under the New Zealand Dietary Supplements Regulations 1985. They have not been evaluated by Medsafe for therapeutic purposes. Always read the label and use as directed. If symptoms persist, see your healthcare professional.

Any health claims made on our Site are supported by scientific evidence and comply with applicable New Zealand and Australian regulations. However, individual results may vary.

To the maximum extent permitted by law (and subject to your rights under the Consumer Guarantees Act 1993), Element3 Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Site or products.

Our total liability to you for any claim arising under these Terms shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.

Your use of our Site is also governed by our Privacy Policy, which sets out how we collect, use, store, and share your personal information. By using our Site, you consent to the practices described in our Privacy Policy.

Our Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those websites. Accessing third-party links is at your own risk.

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
