Subscription & Sales Terms

element³ subscriptions are designed around your rhythm — not ours. Here's how billing works, how to pause or cancel, and what you can expect from each delivery.

[ 01 ] Introduction
Designed around your rhythm
These Subscription & Sales Terms apply to all element³ subscription products purchased through our website. By starting a subscription, you agree to these terms in addition to our Terms & Conditions and Privacy Policy.
Our subscription system is operated through Appstle, a third-party subscription management platform integrated with our Shopify store. Your subscription details, billing schedule, and order history are managed through your customer account.
[ 02 ] How Subscriptions Work
Recurring deliveries on your schedule
When you start a subscription, you authorise element³ to:
- Charge the saved payment method on your account on each billing date
- Ship the subscribed product to your saved address at the chosen delivery cadence
- Continue billing and shipping until you pause, skip, or cancel
Default cadence is every 30 days for Rise and Rest, aligned to a one-month supply. You can change this cadence at any time from your account.
Subscription prices include the active subscription discount displayed at checkout. Your subscription price is locked at the rate you signed up at unless we give you advance notice of a change (see Section 6).
[ 03 ] Pause, Skip & Swap
Flexibility built in
You can manage your subscription anytime from your account dashboard:
- Skip a delivery — push your next order out by one cycle
- Pause indefinitely — keep your subscription on hold without cancelling
- Swap products — change between Rise, Rest, or any future element³ product on subscription
- Change delivery date — shift your next billing date forward or back
- Update your address or payment method — at any time before the next charge
Changes must be made at least 24 hours before your next billing date to apply to the upcoming order.
[ 04 ] Cancellation
Cancel anytime, no hoops
You can cancel your subscription at any time from your account dashboard. There are no cancellation fees, lock-in periods, or minimum subscription terms.
To cancel:
- Sign in to your element³ account
- Go to Manage Subscription
- Select Cancel Subscription and confirm
Cancellation takes effect immediately. You will not be charged for any future deliveries after cancellation. Any order already processed and shipped before your cancellation will not be refunded automatically — see our Returns & Refunds Policy if you need to return an order.
If you’d prefer to cancel via email, contact us at hello@element3.co.nz and we’ll process it within one business day.
[ 05 ] Billing & Payment
Transparent, predictable charges
- Billing date: Set when you first subscribe; you can change this anytime
- Payment method: The card or payment method on file at the time of each charge
- Currency: New Zealand Dollars (NZD) for NZ orders; converted at point of sale for international orders
- Failed payments: If a payment fails, we’ll attempt to charge the card again within 48 hours and email you. After three failed attempts, the subscription will be paused until you update your payment method.
Pre-authorisation holds may appear on your statement at the time of order; the actual charge is processed when your order ships.
[ 06 ] Price Changes
We'll always tell you in advance
If we change the price of your subscription, we’ll email you at least 30 days before the new price takes effect. You can cancel or pause at any time during that notice period if you don’t wish to continue at the new price.
We will never change your subscription price retroactively, and the new price will only apply to deliveries shipped after the notice period ends.
[ 07 ] Returns on Subscription Orders
Same guarantee, same process
Subscription orders are covered by the same returns and refunds policy as one-time orders. If you’re unhappy with a subscription delivery, see our Returns & Refunds Policy for the full process.
If you received an unexpected charge or delivery, contact us at hello@element3.co.nz within 14 days and we’ll resolve it.
[ 08 ] Your Rights
Protected by consumer law
These terms do not limit your rights under applicable consumer law, including:
- New Zealand: Consumer Guarantees Act 1993 and Fair Trading Act 1986
- Australia: Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010)
- United Kingdom: Consumer Rights Act 2015
- European Union: Consumer Rights Directive (2011/83/EU)
- United States: Applicable state consumer protection laws, including California’s Automatic Renewal Law
If you believe your statutory rights have been breached, please contact us before escalating — we want to resolve any issue directly.
[ 09 ] Changes to These Terms
We'll let you know
We may update these Subscription & Sales Terms from time to time. If we make material changes that affect your existing subscription, we’ll email you at least 30 days in advance.
