At Element3 ("we", "us", "our"), we are committed to protecting your privacy. We know that when you buy our supplements, you are trusting us not just with your money, but with your health data. We take that trust seriously.
This Privacy Policy applies to our website, our global operations, and any interactions you have with us. It sets out how we collect, use, store, and share your personal information in accordance with the New Zealand Privacy Act 2020, the Australian Privacy Act 1988, the UK/EU GDPR, and relevant US state regulations.

Three sources, clearly defined
We collect personal information in three main ways: directly from you, automatically when you use our services, and from third parties.

Identity Data: Name, username, or similar identifier. Contact Data: Billing address, delivery address, email address, and telephone numbers. Health & Wellness Data: If you complete a wellness quiz or consultation, we may collect information regarding your dietary preferences, health goals, allergies, or lifestyle choices to recommend specific formulations. Financial Data: Payment card details, processed securely via our third-party payment gateways. We do not store full credit card details. Marketing Preferences: Your preferences in receiving marketing from us.
Information collected automatically:
Technical Data: IP address, browser type, time zone setting, location data, and operating system. Usage Data: How you use our website, products, and services.

Purposeful use, nothing more
We only use your data when the law allows us to. Most commonly, we use it to:
Process your order: Deliver your supplements to you — whether you are in Auckland, London, or New York. Personalise your experience: Tailor supplement recommendations based on the health goals you have shared with us. Improve our products: Analyse data to refine our formulations and develop new products. Communicate with you: Send order updates, customer support responses, and (with your consent) marketing communications. Business operations: For fraud prevention, data analysis, and during capital raising activities where data is aggregated and anonymised for investor reporting.

We don't sell your data. Ever.
We do not sell your personal data to data brokers. However, to operate a global supply chain, we must share data with trusted third parties:
Logistics Partners: To get the product to your door — NZ Post, DHL, FedEx. Technology Providers: Cloud hosting, email marketing platforms, and analytics providers. Regulators & Legal: If required by Medsafe (NZ), TGA (Australia), FDA (US), or other regulatory bodies. Business Transfers: If we merge, sell assets, or complete a capital raise, anonymised customer data may be part of the transferred assets or due diligence process.

Encrypted, limited, time-bound
We use industry-standard encryption (SSL) and security protocols to protect your data. Access to your personal information is limited to employees and partners who have a business need to know.
We only keep your personal information for as long as necessary to fulfil the purposes we collected it for, including for satisfying any legal, accounting, or reporting requirements.

Where your data travels
Because Element3 operates globally:
For NZ/AU Customers: Your data may be processed in the US or UK depending on our server locations. We ensure these transfers are protected by comparable safeguards to the NZ/AU Privacy Acts. For UK/EU Customers: We transfer data outside the EEA only when adequate safeguards — such as Standard Contractual Clauses — are in place.

You're in control
Depending on where you live, you have specific rights regarding your data:
Access & Correction: You can ask for a copy of your personal data and ask us to correct it. Right to be Forgotten (UK/EU): You may ask us to delete your data under certain circumstances. Opt-Out: You can unsubscribe from marketing emails at any time.
